How Strata Rules Impact Your Rental

Unlike detached homes, condos and townhomes are governed by strata bylaws. Before renting out your strata property, it’s important to understand the rules that apply.

Here’s what you need to know:

Changes to Strata Rental Restrictions
In late 2022, new legislation eliminated most rental restriction bylaws in strata buildings. Stratas can no longer ban rentals or limit the number of units that can be rented. However, short-term rentals (such as Airbnb or VRBO) are still often restricted or prohibited.

Age Restrictions May Still Apply
Some stratas enforce age-restricted bylaws (such as 55+ buildings). These rules remain legal, and if your tenant doesn’t meet the age requirement, you cannot rent to them. While not common, it’s important to confirm whether your strata has age restrictions before entering into a rental agreement.

Tenants Must Comply with Strata Bylaws
Even when rentals are permitted, tenants must follow all other strata bylaws—covering areas like parking, noise, smoking, and pet restrictions. As the owner, you’re ultimately responsible if your tenant breaks the rules. Make sure your tenant receives a copy of the bylaws and that compliance is written into your rental agreement.
